The first half of 2024 saw newly enacted laws focused on protecting children’s privacy, regulating the use of artificial intelligence and regulators taking action to enforce the patchwork of privacy laws.

While other states have attempted to boost digital safeguards for children, New York has taken a novel approach by targeting the algorithms being used by social media companies to serve content to minors.
Allison comments on the impact of New York’s law and the legal challenges it faces, as well as actions the FTC has taken in regards to children’s privacy and online activity, “New York has come up with a potential argument to pass constitutional muster by identifying and focusing on a feature that they’re calling addictive and harmful, although it will be interesting to see if there’s any data out there to support the assertion that these algorithms are more harmful than posting this content chronologically.”
