Derick D. Dailey is an associate in the Litigation Practice Group of Davis & Gilbert. Mr. Dailey represents clients on various commercial litigation matters. His practice includes litigating employment disputes, breach of contract and tort claims, and intellectual property issues. He also advises clients on compliance with federal, state, and local law, and assists with internal and regulatory investigations. Mr. Dailey has experience litigating in federal and state courts, including proceedings at both the trial and appellate court levels. In addition, Mr. Dailey advises clients on navigating pre-litigation resolution of complex commercial disputes.

Prior to joining Davis & Gilbert, Mr. Dailey served as an Assistant United States Attorney in the District of Delaware. In this role, he worked on general defensive matters, led civil rights investigations, and was responsible for bankruptcy and restructuring matters. He also served as the Chief of the Financial Litigation Unit, the unit responsible for the district’s collection of restitution. Before becoming a federal prosecutor, Mr. Dailey was an associate at Dowd Bennett, LLP, where he worked on issues relating to healthcare law, corporate compliance, and anti-trust litigation. He also served on the Merit Selection Panel for United States Magistrate Judge Nanette A. Baker of the United States District Court for the Eastern District of Missouri.

Mr. Dailey has been recognized by The National Black Lawyers in their 2021 ranking of Top 40 Under 40 lawyers in New York.

While in law school, Mr. Dailey served as a Stein Scholar and was the National Chair of the National Black Law Students Association.
