Jacklyn M. Siegel is counsel in the Litigation and Intellectual Property Practice Groups of Davis & Gilbert. Her practice includes a broad range of intellectual property, complex commercial and employment issues and disputes. Ms. Siegel regularly represents clients in intellectual property disputes related to copyrights, trademarks, trade dress, rights of publicity, trade secrets, unfair competition and false advertising. She also assists clients seeking to proactively protect their intellectual property rights by asserting and defending their trademarks, copyrights, and domain names. She has experience defending clients in federal and state courts and in proceedings at both the trial and appellate court levels, as well as in resolving alleged claims through pre-litigation dispute resolution.

Ms. Siegel maintains an active commercial litigation practice, representing companies and individuals in a variety of industries in matters related to breaches of contracts, fraud, mergers and acquisitions, payment and ownership interest disputes and business torts. She has also represented clients in employment litigations and workplace investigations involving restrictive covenants and claims of harassment, discrimination and retaliation.

Prior to joining Davis & Gilbert, Ms. Siegel was a litigation attorney at Paul, Weiss, Rifkind, Wharton & Garrison LLP, where she focused on securities and complex commercial litigation matters, including class actions and adversary proceedings in bankruptcy. She also served as a law clerk to the Honorable Richard M. Berman, U.S. District Court, Southern District of New York. During law school, she was an executive editor on the NYU Journal of Legislation & Public Policy.

REPRESENTATIVE ENGAGEMENTS

  • Defended global advertising agencies and their clients against claims of copyright infringement involving the alleged use of visual artists’ works in marketing materials.
  • Obtained the voluntary withdrawal of right of publicity, trademark infringement, and unfair competition claims asserted against a global advertising agency and consumer products company.
  • Resolved license disputes on behalf of a global technology corporation and its advertising agencies related to the use of music compositions and sound recordings in marketing materials.
  • Obtained a judgment as a matter of law, affirmed by the Second Circuit on appeal, in favor of a hedge fund management company and its owner after an erroneous jury verdict finding that they owed money for an employment referral.
  • Obtained a favorable settlement on behalf of a textile manufacturing company in an indemnification and asset purchase agreement dispute following a corporate divestment.
