Navigating the 2016 SAG-AFTRA Commercials Contract

July 26 & 28, 2016

The 2016 SAG-AFTRA Commercials Contract is effective retroactive to April 1, 2016, and will be operative for three years, through March 31, 2019. To help agencies and advertisers better understand the legal and practical implications of the new Commercials Contract, this seminar will address its new provisions, including the expansion of real person waivers to broadcast and testimonials, the experimental social media waiver, changes to the definition of "commercials" made for the Internet, use of stock footage, changes in editing provisions, and the signatories’ right of self-promotion.

Practical takeaways will include:

  • Strategies for competing with non-union agencies and advertisers within the confines of the new Commercials Contract, including determining whether something is considered a "commercial" subject to coverage by the Commercials Contract and practical application of the new waivers
  • Areas that the Joint Policy Committee and SAG-AFTRA may continue to address in order to arrive at a talent payment model that adequately reflects the increasing demand from marketers for digital content
