Managing Health-Related Requests for Accommodation and Leaves of Absence

Responding to employee requests for accommodation and leaves of absence is inherently challenging. Not only has the definition of “disability” expanded, but an employer must navigate the complex interplay between the ADA, FMLA, and state/local law.

This seminar will examine federal and state laws that govern employees’ rights and employers’ responsibilities with regard to these requests, and discuss recent cases shaping the definitions of “reasonable accommodation” and “undue hardship” under the law.

In particular, this seminar will focus on employer best practices for handling employee requests and related benefits issues including:

  • Properly documenting requests, memorializing dialogue with employees and engaging in the interactive process
  • Managing employees with perceived or disclosed mental health issues
  • Absenteeism, misconduct and performance issues with an employee on or requesting leave
  • Health Insurance Portability and Accountability Act considerations in requesting employee medical information and related HIPAA issues
  • Impact of the Affordable Care Act on leave administration
