Daniel A. Dingerson is an associate in the Litigation Practice Group of Davis & Gilbert. Mr. Dingerson has extensive experience advocating on behalf of businesses on a broad range of commercial matters, with a focus on complex commercial disputes and defense of class actions.

Mr. Dingerson represents major advertising agencies and their affiliates with respect to breaches of contract and fraud concerning corporate acquisitions, provision and termination of services, and corporate governance and disputes regarding ownership interests. He has represented major financial institutions in complex securities and antitrust litigation, as well as advertising agencies in internal investigations and government antitrust enforcement actions. Mr. Dingerson regularly represents major retailers and product manufacturers concerning claims of false advertising and deceptive marketing practices.

Mr. Dingerson also investigates and litigates cases of online defamation, and has represented companies and individuals that have been subject to a variety of online attacks. Through investigation and litigation, Mr. Dingerson has identified individuals and entities responsible for anonymously posting false, malicious and defamatory internet content and has obtained removal of content and publication of apologies.

Prior to joining Davis & Gilbert, Mr. Dingerson was a litigation associate at Foley & Lardner, where he represented financial services institutions, real estate corporations, and investment trusts in complex commercial litigation. He also provided services pro bono to individuals in civil rights and intellectual property matters.

REPRESENTATIVE ENGAGEMENTS

  • Defended a major media and technology company through trial and appeal in earnout dispute resulting in dismissal of breach of contract and fraud claims seeking $18 million in damages.
  • Obtained summary judgment and award of over $6 million in statutory damages on a trademark infringement claims for a transportation logistics company.
  • Represented a global investment bank in a multibillion-dollar nationwide antitrust class action and multidistrict litigation brought by municipalities that issued tax-exempt bonds alleging bid-rigging in the procurement of municipal bond investment vehicles.
  • Represented a data and consulting company in dispute with supplier regarding use of products with its own clients and termination of a vendor agreement.
  • Represented a data and marketing services company in dispute with client regarding payment for on-going services and renegotiation of contract terms.
  • Representing an information technology company in litigation concerning termination of vendor agreement and claims for outstanding payments.
  • Representing a specialty products manufacturer in litigation with former client concerning termination of order and return of initial payment.
  • Defended a major fast-casual restaurant chain in a consumer class action alleging that the defendant regularly underfills its wraps, obtaining dismissal of claims for injunctive relief and fraud at the outset of litigation.
  • Investigated and pursued online defamation claims against a former business partner of media company and secured removal and public apology through settlement.
  • Investigated and identified the perpetrator of a widespread anonymous cyber-attack on a hedge fund and its officers and secured removal of defamatory content from the internet.
